How to File a Fire Damage Insurance Claim in Florida
A fire claim is really four claims layered together, fire, smoke, water, and contents. Here is how to file it so none of those layers is left unpaid.
Last reviewed July 2026. General guidance, not legal advice.
A standard Florida homeowners policy covers fire as a named peril, along with the smoke, soot, and firefighting water that come with it. The money is lost in the layers a quick estimate misses, not in the flames.
What a fire claim covers
- Fire and heat damage to the structure.
- Smoke and soot, which travel far beyond the burn area into HVAC, walls, and contents.
- Water and chemical damage from putting the fire out.
- Personal property (contents), usually a separate coverage from the structure.
- Additional Living Expense (ALE) while the home is uninhabitable.
How to file, step by step
- Make sure the property is cleared as safe to enter before going in.
- Photograph and video everything before any cleanup, including smoke and soot lines.
- Report the claim to your insurer promptly.
- Build a room-by-room contents inventory with age and replacement cost.
- Track every displacement receipt for ALE.
- Get the carrier’s estimate in writing and compare it against an independent scope.
Common fire-claim pitfalls
Carriers frequently pay the structure at limits and hand the contents claim back to you, under-scope smoke and soot remediation, and omit code-upgrade costs on the rebuild. On a replacement-cost policy, the withheld depreciation is recoverable once repairs are complete under Florida Statute 627.7011.

How to File a Fire Damage Insurance Claim in Florida FAQs
Yes. Smoke, soot, and the water used to extinguish a covered fire are part of the covered loss, though carriers routinely under-scope smoke and soot remediation.
Usually not. Contents, ALE, and code-upgrade coverage are often separate from the structure payment and can be left unclaimed if you do not pursue them.
